What is Notice of Deficiency?

A notice of deficiency is one of the first steps toward tax court. If the IRS believes that additional tax is due after an examination, it will normally send the taxpayer a letter that gives the taxpayer the opportunity to protest the change at the IRS Appeals Office before litigation.

If the taxpayer and Appeals Office do not settle the dispute, the Appeals Office will issue a notice of deficiency. Also called a 90-day letter, the notice gives the taxpayer 90 days to challenge the deficiency in tax court, a federal court specifically for tax matters. Tax court can be an appealing next step because the taxpayer does not have to pay the deficiency in order to file suit.
