Seattle Tax Attorney Helping With IRS Passport Certification

When the Internal Revenue Service (IRS) certifies your tax debt as seriously delinquent, the U.S. Department of State generally will not issue or renew your passport. It may also revoke one you already hold.

Insight Law represents individuals who face passport denial or revocation and want to reverse the certification behind it. Our IRS passport revocation attorney reviews whether your debt qualifies and explains your options based on your finances and travel timeline.

Seriously Delinquent Tax Debt And Notice CP508C

For 2026, the IRS certifies a debt only when assessed, unpaid and legally enforceable federal tax, penalties and interest total more than $66,000. This threshold adjusts annually for inflation. The agency must also have issued a levy or filed a tax lien notice for which your appeal rights have ended.

The IRS mails Notice CP508C when it certifies your debt. If you apply for a passport or renewal, the State Department holds your application open for 90 days after its denial letter, which leaves time to seek IRS passport denial help.

Resolutions That Lift A Certification

The IRS reverses a certification once the debt no longer qualifies as seriously delinquent. These resolutions remove a debt from that category:

  • An approved installment agreement that you keep current
  • An offer in compromise under review or an accepted offer you are paying as agreed
  • Currently not collectible status based on financial hardship
  • A request for innocent spouse relief that suspends collection of the certified debt

Reducing your balance below $66,000 through partial payments does not reverse a certification. Once you resolve all certified debt, the IRS notifies the State Department within 30 days and sends you Notice CP508R.

Expedited Reversal For Travel Within 45 Days

If your debt qualifies, you may ask the IRS to expedite the reversal for international travel within 45 days or an urgent passport need while you live overseas. Each request requires an open passport application, a State Department denial or revocation letter from the past 90 days and proof of travel. The reversal then generally takes nine to 16 days.

Court Challenges To An Erroneous Certification

You cannot appeal a certification within the IRS, but you may sue in U.S. Tax Court or federal district court if the certification is in error or the agency fails to reverse it when required. If you request a Collection Due Process hearing on time after a levy notice, the levy must pause and that debt cannot count toward certification.
